These Terms & Conditions (“Terms”) govern your use of this website and the text messaging program operated by West Bay Builders LLC (“West Bay Builders,” “we,” “us,” or “our”), a general contractor based in Oldsmar, Florida. By using this website, submitting a quote request, or opting in to our text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website.

1. Using this website

You may use this website to learn about our services and to contact us. You agree not to:

  • Submit false information or information about someone else without their permission
  • Use the website for any unlawful purpose
  • Attempt to disrupt, overload, probe, or gain unauthorized access to the website or its systems
  • Scrape, copy, or harvest content or data by automated means without our written permission
  • Send us spam, malware, or harassing content

2. Quotes, estimates, and construction work

Content on this website is general information, not a bid or an offer. Pricing, timelines, and scope discussed on the website, by phone, by email, or by text message are preliminary and are not binding on either of us.

Submitting a quote request does not create a contract and does not obligate you to hire us or us to perform work. All construction work is governed only by a separate written agreement signed by you and West Bay Builders. If anything in these Terms conflicts with that signed agreement, the signed agreement controls for that project.

3. Text messaging (SMS) terms

Program. West Bay Builders sends service-related text messages to people who have opted in. Messages include replies to quote requests, appointment scheduling and reminders, project and crew updates, and invoice and payment links. We do not send third-party advertising.

How you opt in. You opt in by checking the text messaging consent box on our quote request form, by texting us first, or by giving us your consent in writing or verbally in connection with your project. Consent to receive text messages is not a condition of purchasing any goods or services from us.

Message frequency. Message frequency varies based on your request and the status of your project.

Cost. We do not charge for text messages. Message and data rates may apply, depending on your mobile plan.

Opt out. Reply STOP to any text message from us to cancel. You will receive one final message confirming you have been unsubscribed, and no further messages after that. To rejoin, opt in again on our quote request form or reply START.

Help. Reply HELP to any text message from us, or contact us at (727) 946-4576 or office@westbaybuildersfl.com.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device and is not guaranteed.

Eligibility and your number. You must be 18 or older and the account holder or an authorized user of the mobile number you provide. If you change or give up your number, tell us so we can stop texting it.

Privacy. We do not sell or share your mobile number or text messaging consent with third parties or affiliates for their marketing purposes. See the text messaging section of our Privacy Policy.

Text messages are not monitored around the clock. Do not use text messages to report an emergency or an urgent jobsite safety issue; call us, or call 911.

4. Intellectual property

This website and its content, including text, photographs, designs, logos, and project imagery, are owned by West Bay Builders or our licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.

5. Information you send us

You are responsible for the accuracy of information, photos, and documents you send us, and you confirm you have the right to share them. We use them to evaluate and respond to your request as described in our Privacy Policy.

6. Third-party links

This website may link to sites we do not operate. We do not control or endorse them and are not responsible for their content, products, or practices.

7. Disclaimers

This website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Project photos, articles, and cost or timeline examples are illustrative; every project is different. Nothing on this website is engineering, legal, or financial advice. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

Warranties on construction work are provided only in your signed project agreement and as required by Florida law. Nothing in these Terms limits them.

8. Limitation of liability

To the fullest extent permitted by law, West Bay Builders and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising from your use of, or inability to use, this website or our text messaging program. Our total liability for any claim arising from the website or text messaging program will not exceed one hundred U.S. dollars ($100).

This section applies only to the website and text messaging program. Liability for construction work is governed by your signed project agreement and applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless West Bay Builders from claims, damages, and expenses, including reasonable attorneys’ fees, arising from your misuse of this website or your violation of these Terms.

10. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the website, or the text messaging program will be brought exclusively in the state or federal courts serving Pinellas County, Florida, and you consent to the jurisdiction of those courts.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and update the effective date above. Your continued use of the website or text messaging program after changes are posted means you accept the updated Terms.

12. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms and our Privacy Policy are the entire agreement between you and us regarding the website and text messaging program.
